What is Happening:

The Post-Copenhagen international landscape presents an excellent opportunity for us all to think broadly about new approaches and ideas Australia could bring to the table in 2010 and beyond. Last year Australia led the way on legal architecture discussions, in particular with our ‘National Schedules’ proposal which shaped negotiations to the very end in Copenhagen. Crucial issues remain open in 2010 and once again other Parties are looking to Australia to be a thought leader to progress negotiations. At this session we will consider the following areas as being of particular interest to Australia’s post-Copenhagen strategic direction:

  • UNFCCCC Architecture
  • What lessons can we draw from other multilateral regimes on design of the UNFCCC architecture?
  • Is a comprehensive legally binding instrument a necessary prerequisite to environmental effectiveness or are there examples of successful ‘hybrid’ architectures (incorporating binding and non-binding commitments) which have achieved results?
  • Do all multilateral regimes capture highest ambition (set the ‘ceiling’) for international commitments or are they best placed to set minimum standards (a ‘floor’)?
  • This question raises the linkage between complementary bilateral and regional forums and multilateral forums – what other regimes are informative?
  • Measurement, Reporting and Verification; Compliance and Dispute Settlement

Are there mechanisms from other international regimes which might be instructive in unlocking these difficult issues in the UNFCCC? For example, Australia and others considered ‘peer review’ processes (used at the WTO, OECD, UN Human Rights Council) as potentially applicable in the UNFCCC context last year.
